Terms & Conditions

Welcome to Electroniconch.com. These Terms and Conditions (“Terms”) govern your use of our website and the rental of equipment or booking of services from Electroniconch Records (“the Company,” “we,” “us,” or “our”). By placing an order or booking a service, you agree to be bound by these Terms.

1. RENTAL EQUIPMENT & OWNERSHIP

  • Ownership: All equipment remains the sole property of Electroniconch Records.

  • Condition of Equipment: We ensure all gear is tested and in working order before delivery. The Customer ("Lessee") is responsible for inspecting the equipment upon delivery. Any defects must be reported immediately.

  • Usage: Equipment must be used for its intended purpose. The Lessee shall not modify, repair, or sub-rent the equipment to third parties.

2. BOOKING, PAYMENTS & DEPOSITS

  • Reservations: A booking is only confirmed once a deposit (typically 50% or as specified) is paid.

  • Final Payment: The remaining balance is due prior to or at the time of delivery/setup.

  • Security Deposit: We reserve the right to request a valid Credit Card and Photo ID on file as a security measure against loss or damage.

3. CANCELLATIONS & REFUNDS

  • Standard Policy: Cancellations made more than [e.g., 14 days] before the event may be eligible for a full refund of the deposit.

  • Late Cancellations: Cancellations made within [e.g., 7 days] of the event may result in the forfeiture of the deposit.

  • Weather/Force Majeure: If an event is cancelled due to extreme weather or "Acts of God," we will attempt to reschedule. Deposits for weather-related cancellations are generally non-refundable but may be applied as credit for future dates.

4. DELIVERY, SETUP & SITE CONDITIONS

  • Access: The Lessee must ensure the venue provides adequate access (ramps/elevators) and a safe, dry, and level area for equipment setup.

  • Power Requirements: The Lessee is responsible for providing a stable 120V power source. Damage caused by improper power (surges, low voltage) is the responsibility of the Lessee.

  • Environment: Equipment must be kept indoors or under professional-grade overhead shelter. We reserve the right to refuse setup or remove equipment if conditions (rain, extreme heat, or unsafe crowds) pose a risk to the gear or staff.

5. DAMAGE, LOSS & LIABILITY

  • Lessee Responsibility: From the moment of delivery until the moment of pickup, the Lessee is 100% responsible for the equipment. This includes damage from liquids, theft, "party foul" accidents, or misuse by guests/artists.

  • Replacement Cost: In the event of total loss or irreparable damage, the Lessee agrees to pay the full current market replacement value of the equipment.

  • Liability: Electroniconch Records is not liable for any injuries, property damage, or financial loss resulting from the use of our equipment or services.

6. DJ SERVICES (If Applicable)

  • Performance: Our DJs will provide professional entertainment as agreed. While we accept music requests, we cannot guarantee the availability of every specific track.

  • Safety: The DJ reserves the right to stop the performance if the environment becomes hostile or dangerous. In such cases, no refunds will be issued.

7. GOVERNING LAW

  • These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Monroe County (Key West) or Miami-Dade County, depending on the service location.
